Penstar Would Pay $6,000 Fine Under Settlement with PUCT Staff Relating to Customer Verification

Penstar Power, L.L.C. would pay an administrative penalty of $6,000 under a settlement with PUCT Staff to resolve a Staff investigation concerning Penstar's compliance with P.U.C. Subst. R. 25.474, concerning selection of a retail provider and P.U.C. Subst. R. 25.480, concerning bill payment requirements (Docket 38783).

The investigation was prompted by a complaint.

A proposed finding of fact in the settlement states that Penstar was not in compliance with Subst. R. 25.474(h)(5)(A) because the company was unable to provide verification that an electronic recording of the applicant's verification had been obtained; and was not in compliance Subst. R. 25.474(i) because the company failed to maintain non-public records of each applicant's authorization and verification of enrollment for 24 months from the date of enrollment.

A proposed finding of fact further states that Penstar was not in compliance with Subst. R. 25.480(b) because the company issued a bill with a payment due date less than 16 days after issuance.
