PUCT Adopts Modified Preliminary Order Regarding Clearview Waiver Request

The PUCT adopted a modified preliminary order concerning Clearview Electric's petition for a waiver of the financial requirements of Subst. R. 25.107(f) (see earlier coverage).  

The preliminary order adopted by the Commission holds that there is no per se exception to §25.107 due to a REP's small customer book, but directs the ALJ at the State Office of Administrative Hearings to consider a series of questions proposed by Commissioner Kenneth Anderson to determine whether Clearview has presented good cause for a waiver absent a per se waiver (see discussion in Matters, 10/14/10).

Additionally, a question from Commissioner Donna Nelson was added to the list of issues to be considered in the case.  Specifically, Nelson asked, if the Commission elects to grant a waiver, for how long should the waiver be granted.
