PUCT Staff Opposes TexRep6 Motion for Stay of Revocation Proceeding PUCT Staff have
opposed a request from TexRep6, LLC to stay Staff's petition to revoke TexRep6's
REP certificate for failure to meet the requirements of several provisions of Subst.
R. 25.107(f) & (g). As only noted in Matters (10/14/10), TexRep6 had sought a stay
to complete additional financing. "Staff opposes TexRep6's request to stay. TexRep6's
current attempt to come into compliance with Commission rules and requirements does
not cure the violations at issue in this docket. Specifically, TexRep6 was required
to be in compliance with P.U.C. SUBST. R. 25.107(f)(1), (f)(2), (g)(1)(d), and (g)(1)(E)
by May 21, 2010, or to cease operations at that time. Therefore, Staff requests
that TexRep6's Motion to Stay be denied so that these violations may be addressed,"
Staff said. TexRep6 was previously purchased by IC&T Americas, LLC, which is now
known as Smartcom Energy Technologies, LLC.
