Meadville “Blindsided” by Declaratory Order Petitions Filed by Retail Suppliers

The Meadville Tribune reports today that Joe Chriest, Meadville’s city manager, was “blindsided” by separate petitions from the Retail Energy Supply Association and Dominion Retail for a declaratory order from the Pennsylvania PUC finding municipal opt-out aggregations to be illegal absent enabling legislation.  As previously reported, Meadville has passed such an opt-out ordinance.  The declaratory order petitions were first reported by Matters (11/1 & 11/4).  The Tribune also reports that an additional city, Warren, not cited in either the RESA or Dominion Retail petition, has passed an ordinance for opt-out aggregation.  The Times Observer provides additional detail on the Warren ordinance.

Texas ALJ Won’t Act on Dallas REP Certificate Rehearing Request

A PUCT ALJ declined to act on a rehearing request from the City of Dallas regarding the denial of its application for a REP certificate (38630), as the ALJ found that PURA § 11.003(7) excludes a "municipal corporation" from the meaning of "person" in PURA § 11.003(14).  PURA 39.352(b) provides for certification, as a REP, of a "person" that satisfies a specified criteria, and thus does not include municipal corporations, the ALJ said.  The rehearing request is on the agenda for the Commission’s November 10 open meeting.  The denial of the Option 2 REP application (9/28) and application itself (9/3) were first reported by Matters.
