Champion Energy Services Would Pay $30,000 Under Settlement with PUCT Staff to Resolve Compliance Audit

Champion Energy Services would pay $30,000 under a settlement with PUCT Staff to resolve allegations from Staff that Champion violated 12 provisions of the Substantive Rules relating to consumer protection (38905).

Staff's allegations resulted from a compliance audit.

Among other things, Staff alleged that Champion was not fully compliant with the following:

• SUBST. R. 25.474(h)(4)(H) relating to telephonic enrollment, by not disclosing the applicant's right to rescission
• SUBST. R. 25.475(e) relating to contract expiration and renewal offers, by not sending contract expiration notices to small commercial customers
• SUBST. R. 25.475(e)(2)(E) relating to affirmative consent, by not providing an estimated start date or end date
• SUBST R. 25.475(g) relating to the Electricity Facts Label (EFL), by not providing an EFL to small commercial customers.

Champion Energy Services has since corrected all of the alleged areas of non-compliance cited by Staff.
