Mega Energy Would Pay $42,400 to Resolve PUCT Staff Allegations of Consumer Protection

Mega Energy, LP has entered into a settlement with PUCT Staff under which it would pay an administrative penalty of $42,400 to resolve allegations that Mega Energy violated 25 provisions of the substantive rules (Docket 38982).
The settlement results from a compliance audit conducted by Staff.
Among other things, Staff alleged that Mega Energy was not fully in compliance with the following provisions:
- P.U.C. SUBST. R. 25.475(c)(2)(D) relating to general contracting requirements. The company's terms of service (TOS) did not disclose the type of product using one of the terms named in the rule.
- P.U.C. SUBST. R. 25.475(c)(2)(G) relating to general contracting requirements. The company's website did not provide information on the variable rate product.
- P.U.C. SUBST. R. 25.475(d)(4)(F) relating to changes in contract and price and notice of changes. The company's contract change form did not include the statement required by this rule.
- P.U.C. SUBST. R. 25.475(g)(2)(D) relating to Electric Facts Label (EFL). The company's EFL did not contain the required usage level for determining the average price for electric service.
Prior to entering the settlement, Mega Energy has corrected all of the alleged violations.
