Md. Staff: Comptroller Informally Says Gas Brokers Do Not Need Sales & Use Tax License

Maryland PSC Staff have been informed orally by the Comptroller of Maryland that a sales and use tax license is not needed for natural gas brokers.

However, Staff has not yet secured a written letter from the Comptroller's office formalizing such finding, though Staff is continuing to work with he Comptroller's office to obtain such a letter.

Maryland's gas broker license application (which is the same as used for load serving suppliers) currently requires applicants to obtain a sales and use tax license. It appears that until Staff obtains a written letter from the Comptroller's office regarding the sales and use tax license requirement for brokers, the PSC will continue to require applicants to obtain such a license.

Although not entirely clear from discussions at yesterday's administrative meeting, based on Staff's description, it would appear that the exemption from the requirement to obtain a sales and use tax license applies only to entities not taking title to gas.
