PUCT Grants ERCOT Authority to Procure Additional EILS Resources for April through May

The PUCT yesterday granted ERCOT the authority to procure additional Emergency Interruptible Load Service (EILS) under a new contract period, limiting such emergency authority to April through May 2011 (2/28).

Commissioners were open to taking a long-term look at the EILS product and potential changes, but said any such changes were not appropriate on an emergency basis.

The Commission adopted Staff's recommended language for the emergency procurement, through changes to Subst. R. 25.507, which were first reported in Matters (3/23).

ERCOT said that some EILS resources did not perform in the recent February 2 EILS event, and said that it would only procure EILS for the April and May 2011 contract period from resources which it has been able to confirm responded according to the Protocols during the event.

The procurement will be for up to 1,000 MW of EILS resources. As is current practice, ERCOT said that it may not procure EILS capacity in the emergency contract period if the MWs offered, "[are] not priced reasonably and therefore deemed sufficient to provide ERCOT with a useful operational tool."

The otherwise required 90-day notice period for the procurement is waived under the emergency rules adopted yesterday.

The additional contract period of April and May 2011 is required because of the exhaustion of allowable deployments of the previously procured EILS resources for the current period which runs through May 2011.
