Pa. OCMO Issues Data Request Regarding Suppliers' Use of Independent Contractors

Pennsylvania's Office of Competitive Market Oversight has requested each electric generation supplier and natural gas supplier licensed to provide residential service to answer several questions relating to the use of independent third party contractors for sale and marketing activities.

The data responses will inform Staff's report and recommendation to the Commission on the use of independent contactors, and whether such contractors should be required to be individually licensed. Staff's report is due by April 30.

Suppliers using independent contractors for residential service are directed to report, among other things, a "general description" of the compensation arrangements made with each independent party contractor for each type of marketing and/or sales activity performed.

OCMO further requested that suppliers provide the number of complaints the supplier received from residential customers from January 1, 2010 through February 28, 2011. The data requests further direct suppliers to report the number of complaints relating to slamming, and to marketing and sales activities, and to identify the number of such complaints related to independent contractors.

Additionally, OCMO requested that suppliers report the total number of residential customers enrolled from January 1, 2010 through February 28, 2011, and the number of such enrollments resulting from activities performed by independent third party contractors.

Docket I-2011-2233063 has been opened for OCMO's investigation and report.
