PUCT Staff Seeks Revocation of Allstate Power REP Certificate

PUCT Staff have filed a petition to revoke the REP certificate of State Power, Inc. d/b/a Allstate Power Company, alleging that Allstate is not in compliance with several provisions of Subst. R. 25.107 (39338).

Allstate Power is not currently serving, and has never served, customers.

Staff alleged that Allstate has not demonstrated compliance with Subst. R. 25.107(f)(1) & 25.107(f)(2), relating to the financial requirements, and Subst. R. 25.107(g)(1)(D) & 25.107(g)(1)(E), relating to the technical and managerial requirements required for a REP.

Additionally, Staff said that Allstate has not provided retail electric service to customers within 24 months of certification, as required by Subst. R. 25.107(j)(13). Allstate was granted a REP certificate on October 14, 2007, but has yet to serve customers.

Staff said that Allstate's authorized representative as listed in the Commission's records is Dwight Berry, with an address of 3 Riverway, Suite 1900, Houston, Texas 77056.

Staff further said that the registered agent for process for Allstate on file with the Secretary of State is Z. Ed Lateef, at the same address.

That address would be the same as for Sure Electric (d/b/a Riverway Power), which defaulted in 2008, where Dwight Berry served for a time as CEO, and Z. Ed Lateef was, at a minimum, an investor, and alleged by Staff to have been a principal, though this characterization has been disputed (in the ongoing dPI revocation proceeding, whose certificate is indirectly owned by Lateef via its purchase by Amvensys, see (12/15).
