PUCT Approves Settlement Under Which AllStar Energy Will Relinquish REP Certificate

The PUCT accepted without significant modification a settlement that will require TexRep5, LLC d/b/a AllStar Energy to relinquish its REP certificate.

The settlement was slightly modified to make clear that AllStar principals Neil Leibman and Tom O'Leary, who under the stipulation may not mot serve as a principal, officer or in a similar role for another REP for 18 months, will not automatically be presumed to meet the PUCT technical or managerial requirements for REP certification after the 18 months expire, and that the PUCT will retain its ability to review their fitness for any future involvement in a REP.

AllStar will also pay a $52,000 fine.

The case was initiated after Staff alleged that AllStar failed to disclose adverse actions taken against Horizon Power & Light (where Leibman and O'Leary also served as principals) by the Delaware PSC.
