Liberty Power Affiliate Would Pay $39,000 to Settle PUCT Staff Compliance Audit

LPT, LLC would pay $39,000 under a settlement with PUCT Staff to resolve allegations that LPT, LLC was not in full compliance with 25 provisions of the Substantive Rules (39386).

LPT, LLC is a subsidiary of Liberty Power. The allegations resulted from a Staff compliance audit.

Specifically, Staff alleged that LPT, LLC was not in full compliance with the following:

- P.U.C. Subst. R. 25.475(g)(3)(B), relating to fee disclosures. Staff alleged that the company's Electricity Facts Label (EFL) did not list all fees that may be assessed by the REP.

- P.U.C. Subst. R. 25.475(e)(1(C)(ii), relating to contract expiration and renewal offers. Staff alleged that the company's expiration notice did not contain information regarding fees or charges applied if customer terminates the contract before 14 days from expiration.

- P.U.C. Subst. R. 25.478(j)(2), relating to refunding deposits and voiding letters of guarantee. Staff alleged that the company was not refunding deposits for customers de-enrolled within the required time period.

- P.U.C. Subst R. 25.479(c)(6), relating to bill content. Staff alleged that the company's billing did not include a date in which a fixed rate product would expire.

Prior to settlement, LPT, LLC corrected all of the alleged deficiencies.
