Illinois Issues Second Notice Order on Revised Broker Rules

June 16, 2011
Email This Story

The Illinois Commerce Commission has issued a second notice order regarding revisions to the electric agent, broker, and consultant rules under 83 Ill. Adm. Code 454 (Docket 10-0733).

The rules as amended by the Commission will now be submitted to the Joint Committee on Administrative Rules to begin the second notice period, before final approval.

As previously reported (5/3), the amended rules will require, on or after July 1, 2011, that ABCs disclose in writing to customers, "the total price per kilowatt-hour, and the total anticipated cost, inclusive of all fees or commissions received by the licensee [ABC], to be paid by the customer over the period of the proposed underlying customer contract."

In the event that an ABC uses an electric supply usage estimate for a particular customer, ABCs must use the same electric supply usage estimate for all service offers it presents to that particular customer.

Such disclosures shall be made prior to entering into the contract and signed by the customer.

ABCs shall also, "[d]isclose if applicable, to all customers, prior to the customer signing a contract the fact that they will be receiving compensation from the supplier."
