FERC Orders NYISO to Share Confidential Market Participant Data

Due to a complaint from several capacity suppliers disenchanted with current New York ISO ICAP market pricing, FERC has ordered NYISO to share with the complainants, under a protective order, confidential details regarding NYISO's application of buyer-side market power screens to several new capacity resources, which includes project-specific cost and other information for two at-issue capacity resources (EL11-50). NYISO had opposed the disclosure of such information to competing market participants, even subject to a protective order, in order to protect sensitive market participant information, prevent collusive bidding behavior, and avoid enabling market participants to inappropriately evade mitigation when it is warranted. FERC ignored these concerns.


Conn. AG Seeks Delay in UI Time of Use Pricing Docket

The Connecticut Attorney General submitted a letter to PURA supporting what the AG said was the Connecticut Department of Energy and Environmental Protection's request to suspend Docket No. 05-06-04RE06, Application of the United Illuminating Company to Increase its Rates and Charges – Review of VPP Pricing, Mandatory TOD and Seasonal Rates, under which PURA has recently proposed expanding mandatory Time of Use default service rates to all customers (8/9). However, in a letter filed with PURA August 30, DEEP made no such request, and, based on the contents of the publicly posted letter, DEEP only sought a suspension of two advanced meter dockets, but not Docket No. 05-06-04RE06 (8/31). It's unclear if DEEP sought a suspension of the United Illuminating TOU docket separately, but nothing has yet been posted publicly if that is the case.


BlueStar's Jon Casadont Wins First Chair Award

BlueStar Energy Solutions Chief Legal Officer Jon Casadont was named a winner of the 2011 First Chair Award for Top General Counsel. According to First Chair, the awards program is an annual selection of in-house counsel who, through hard work and innovation, made significant contributions to the legal community in the past year. Casadont was one of 24 recipients selected from a national field of 500 nominees in the Top General Counsel category.
