Anderson Recommends Deadline for Clearview to Cure Proposed Suspension of REP Certificate

The PUCT today deferred action on a proposed order which would suspend Clearview Electric's REP certificate, under which Clearview could continue serving its existing small customer base in ERCOT but be prohibited from enrolling new customers in Texas.

The Commission granted additional time for parties to address several recommended revisions to the proposed order from Commissioner Kenneth Anderson.

Most notably, Anderson proposed that a specific time limit be placed on the certificate suspension and for Clearview to come into compliance with the financial security requirement, with revocation of the certificate occurring if Clearview does not come into compliance by that deadline.

Anderson did not propose a specific date, instead wishing to hear from parties first.

Parties were not prepared to discuss specific deadlines at today's open meeting, and the Commission accordingly deferred the matter until its September 15 meeting.
