PUCT Staff Says TexRep6 in Compliance With Financial, Technical, and Managerial Certification Requirements

PUCT Staff said that TexRep6, LLC is now in compliance the financial, technical, and managerial requirements for REP certification, including the financial provisions of Subst. R. 25.107 (38732).

As only noted by Matters, the PUCT had previously abated consideration of a proposed order which would revoke TexRep6's REP certificate for non-compliance with the certification rule by a May 2010 deadline in order to provide Staff with additional time to review several measures TexRep6 recently completed to come fully into compliance on a prospective basis (see 8/3).

Though it made no formal commitments, the Commission had been leaning, albeit with frustration, towards not revoking TexRep6's certificate if the company had indeed come into compliance with all provisions of the Substantive Rules.

The Commission is to further consider the issue at its September 15 open meeting.

TexRep6, LLC is owned by Smartcom Energy Technologies, LLC, f/k/a IC&T Americas, LLC. TexRep6 has indicated it will seek to amend its REP certificate to change its name to Smartcom Energy Services.
