PUCO Issues Show Cause Order to 20 Suppliers/Brokers, With License Revocation to Follow Absent Compliance

The Public Utilities Commission of Ohio directed 20 energy suppliers and brokers to show cause why PUCO should not revoke such entity's certification for what PUCO alleged was failure to file an annual report of sales and receipts for 2010 (11-03-GE-RPT).

Such suppliers, aggregators, and brokers include:

AK Electric Supply LLC

City of Bexley

City of Broadview Heights

City of Dover

City of Gahanna

City of Reynoldsburg

Co-exprise, Inc.

Continental Energy Group, LLC

Early Bird Power, LLC

Energy Resource Group, LLC

EnergyUSA-TPC

Future Now Energy LLC

GSE Consulting, LP

HB Hayes & Associates, LLC

Midwest Utility Consultants, Inc.

UGI Energy Services, Inc.

Village of Bradner

Village of Grafton

Village of Lakeview

World Energy Solutions, Inc.

PUCO granted each entity listed above 10 days to show cause why its certification or operating authority should not be revoked. Should an entity fail to do so, PUCO directed that the Commission's Docketing Division should issue notice that the reporting entity's certification or operating authority was revoked effective 10 days after the issuance of PUCO's Sept. 14 order to show cause.

Any entity seeking to maintain or restore its certification or operating authority after that date may be assessed a forfeiture of $100.00, pursuant to Section 4905.54, Revised Code.

Section 4905.10(A), Revised Code, requires that any reporting entity pay at least $100 minimum assessment regardless of intrastate gross revenues.

PUCO stated that while, in past years, the Commission has not enforced this provision for entities who reported no Ohio intrastate gross revenues, "all reporting entities are hereby notified that in future years, the Commission intends to assess the $100 minimum for all reporting entities, including brokers and governmental aggregators who have no intrastate gross revenues."
