PUCT Sets Schedule for Review of Entergy Competitive Generation Service Tariff

The PUCT directed parties involved in the review of a competitive generation service tariff at Entergy Texas to file by November 1 a list of: (1) agreed issues; (2) unresolved issues pending a Commission ruling on core issues and (3) core issues requiring adjudication by the Commission so that other issues may move forward.

Settlement negotiations lasting nearly a year have not reached consensus on major issues in the case.

As only reported by Matters (12/1), consideration of the competitive generation service tariff was previously severed from Entergy's rate case.

Major unresolved issues regarding competitive generation service, which by legislation is to be available to large customers as a condition of discontinuing further work on Entergy's transition to competition study, include the customers eligible for such service, a potential cap on such competitive load, the pool of potential suppliers (such as limiting suppliers to Qualifying Facilities in the Entergy Texas footprint), and most significantly, the customer classes bearing cost recovery for the service, particularly any unrecovered costs faced by Entergy resulting from customers' election of competitive generation.

The PUCT also denied industrials' motion for an order on a prior proposal for decision in light of the Commission's direction to file a list of issues.
