Just Energy, Customer Settle Billing Dispute Which Implicated Treatment of UFE in ERCOT Market

Taqueria El Zarape (TEZ) and Just Energy Texas, LP have filed a stipulation (38448) to resolve a billing dispute brought before the PUCT which originally implicated larger market issues such as how REPs pass through ERCOT unaccounted for energy (UFE) and RMR charges (4/27/10).

Settling parties agree that from March 27, 2007 through October 15, 2008, Just Energy did not collect from TEZ any unauthorized charges, resulting from improper calculation or any other reason, in violation of P.U.C. SUBST. R. 25.481 or the terms of service.

The stipulation also provides that Just Energy's methods for calculating and passing through the costs of the ERCOT Administration Fee, ERCOT RMR, and UFE were consistent with the terms of service and Commission rules.

The settlement also stipulates that Just Energy improperly entered the ERCOT Administration Fee amount for April 1, 2008 in calculating its charges to TEZ.

This resulted in TEZ being charged an additional $4.08 (total for all accounts). Just Energy refunded this amount plus interest to TEZ in accordance with P.U.C. SUBST. R. 25.480(d).
