PUCT Staff Propose Level for Demand Ratchet Waiver

PUCT Staff have filed a draft proposal for publication to exempt certain non-residential secondary voltage service customers from the demand ratchet (39829).

Specifically, under Staff's proposal for publication, a demand ratchet shall not apply to a non-residential secondary voltage service customer that has an annual load factor less than or equal to 25 percent. The load factor threshold would be uniform across TDUs.

A TDU would be required to determine annually for each of its non-residential secondary service customers whether to apply a demand ratchet.

The proposed rule further provides that the base rates set for non-residential secondary voltage service customers shall provide that these customers shall be billed on a kilowatt hour (kWh), kilowatt (kW), or kilovolt-amperes (kVa) basis.

The proposal implements House Bill 1064.
