Texas Commissioner Anderson: Nothing in Brattle Report Would "Cause Me to Change Where I Am"

The Public Utility Commission of Texas has directed Staff to begin a process to consider recommendations contained in The Brattle Group's report on resource adequacy.

PUCT Commissioner Kenneth Anderson, having gone through the Brattle report once and now going through it more carefully, said that, "there's nothing in there that has, at least with respect to the long-term rule, that would cause me to change where I am, other than it seems to reinforce the $9,000 [system wide offer cap] number."

Brattle's report offered no definitive recommendations for future policy, but did present several options, one of which was a mandatory capacity obligation cleared through a centralized auction. Anderson has previously expressed skepticism of such mechanisms, typically referred to as capacity markets.

Anderson did note Brattle's report confirms that attention should be paid to the curve used to get to the cap.

The Commission directed Staff to open a new resource adequacy project for consideration of additional options as a result of the Brattle report.

This Brattle report proceeding will be separate from the current long-term resource adequacy rulemaking in Project 40268. The Commission intends to adopt a final long-term resource adequacy rule in Project 40268 no later than September 28, and the Brattle proceeding is to consider additional measures not covered by Project 40268.

The Commission directed Staff to schedule a workshop in August for consideration of the options presented by the Brattle Group and any stakeholder proposals. This August workshop is not to cover any issues currently addressed in the long-term resource adequacy rulemaking in Project 40268, in order to avoid delaying final resolution of that rulemaking.

The Commission intends to consider final adoption of a rule concerning short-term resource adequacy measures, namely a potential change in the System Wide Offer Cap effective August 1, 2012, at the June 28 open meeting.
