True Electric to Pay $16,000 to Settle Texas Staff Compliance Audit True Electric L.L.C. would pay $16,000 under a settlement with Staff of the Public Utility Commission of Texas to resolve allegations that True Electric was not in full compliance with 18 provisions of the Substantive Rules (41424).
The allegations resulted from a compliance audit.
Among other things, Staff alleged that True Electric was not in full compliance with the following:
• P.U.C. SUBST. R. 25.474(d)(5)(D) relating to enrollment via the internet. Staff alleged that True failed to disclose all of the prices of the product.
• P.U.C. SUBST. R. 25.474(d)(5)(I) relating to enrollment via the internet. Staff alleged that the stated timeframe associated with the right of rescission was incorrect.
• P.U.C. SUBST. R. 25.475(g)(2) relating to the EFL document. Staff alleged that the price per kWh was missing.
• P.U.C. SUBST. R. 25.480(h)(2) relating to level and average payment plans. Staff alleged that the request for a levelized payment plan incorrectly terminated the rates and term of an existing contract.
Since receiving the results of the Commission's compliance audit, True has voluntarily taken corrective actions to come into compliance with the Commission's statutory and regulatory requirements relating to customer protection as identified by Commission Staff, including instances where True's interpretation of Commission rules differs from that of Staff in order to avoid the potential for expensive and protracted litigation.
