PUC Subjects Retail Supplier to Conditions in Granting Expanded License
The Pennsylvania PUC would grant, in a tentative order, Palmco Energy PA, LLC an expanded natural gas supplier license, but, due to certain complaints against an affiliate, subjected the license to certain compliance and reporting conditions.
Specifically, the PUC's tentative order would conditionally grant Palmco Energy PA, LLC's request that its license be expanded to include service to all customer classes at Peoples Natural Gas and Equitable Gas. Previously, Palmco Energy had been granted authority to serve customers at PECO, Philadelphia Gas Works, Columbia Gas, UGI Utilities, UGI Penn Natural Gas, and UGI Central Penn Gas.
The PUC noted that affiliate Palmco Power PA, LLC has had a high number of complaints filed by the electric distribution customers it serves. "While the sheer volume of complaints applicable to Palmco does not itself demonstrate a compliance problem or inappropriate behavior, a number of the complaints include allegations or other indicators of possible problems so as to cause concern. As a result, we intend to impose some additional conditions on Palmco. We note that we have mandated similar conditions for other electricity generation suppliers and natural gas suppliers seeking licenses," the PUC said.
The following conditions would be imposed on Palmco Energy for a period of 12 months from the start of the company's marketing activities in the state:
a. In its response to the Commission's Bureau of Consumer Services (BCS) regarding complaints alleging the inaccurate explanation of the pricing and the role of the agents during the verification process; improper enrollment or deception, Palmco Energy PA, LLC shall provide BCS with copies of the documentation that Palmco Energy PA, LLC has supporting its position. The documentation can include written enrollment forms, disclosure statements, audio recordings, third party verification, marketing and sales materials and any other relevant documentation. Failure to provide documentation supporting an enrollment may result in a finding against Palmco Energy PA, LLC and possible referral to the Commission's office responsible for enforcement action.
b. Palmco Energy PA, LLC will provide a report the first week of each calendar quarter to staff capturing: (i) the complaints filed directly with Palmco by the following categories: a) misrepresentation/misidentification b) pricing c) agent conduct d) unauthorized switching (slamming); (ii) the resolution for each complaint and (iii) any process improvements/changes, organizational changes, etc. implemented to reduce and/or eliminate similar complaints going forward;
c. Palmco Energy PA, LLC will provide a single point of contact for Commission staff for resolution of consumer inquiries and/or complaints received by BCS.
d. Palmco Energy PA, LLC shall operate in accordance with BCS requirements for complaint management and handling, including certain deadlines for responses
