Regulator Revokes Licenses of Retail Supplier
The Ontario Energy Board has revoked the electricity and natural gas supplier licences of Energhx Green Energy Corporation for failure to pay a previously ordered administrative penalty.
The previously ordered administrative penalty of $10,000 (Canadian), issued in March 2012, related to non-compliance with various consumer protection requirements.
Energhx had sought several extensions of the deadline for payment of the penalty, but the Board declined to grant any extensions beyond August 2013.
According to the Board, "Energhx has asked that the Board refrain from revoking its licences on the basis of its current financial position. The Board acknowledges Energhx's argument. However, the Board has granted a number of extensions to Energhx to allow it time to pay the Penalty. It is the Board's expectation that a licensee will be able to meet its financial obligations and as a result this argument is not persuasive."
Energhx had voluntarily suspended marketing in September 2011 and has not entered into a new contract, or renewed, amended, or extended any contract, since the commencement of the self-suspension.
In an August 2013 filing, Energhx said that it was seeking to continue to supply the six electricity accounts being served under the electricity licence, with new enrollments suspended until the penalty was paid.
