Ohio Denies Nonbypassable Capacity Charge Sought by Duke
The Public Utilities Commission of Ohio rejected Duke Energy Ohio's application to defer and collect, via a nonbypassable charge, the difference between the compensation for its capacity provided under a prior settlement, which linked compensation to PJM prices, and the value of such capacity as would be determined under a proposed state compensation mechanism (as done at AEP Ohio). PUCO ruled that Duke's application contravened a settlement signed by Duke under which Duke agreed that it would only be compensated at PJM prices for the at-issue capacity.
