Here's What ESCOs Will Be Required to File, and What New York Will Disclose, in Reporting ESCO Historic Pricing

As noted Friday, the New York PSC has ordered electric and natural gas ESCOs to file pricing history for certain residential and small commercial products.

With the PSC's written order in its retail market investigation, we have some more clarity on what information will be required, and how it will be presented.

Interestingly, unlike Texas (for residential variable products), it does not appear that the PSC is requiring pricing history for specific individual products, as the PSC is instead asking for average aggregate rates for certain product types.

Specifically, the PSC said that ESCOs shall file, "a separate average unit price for products with no energy-related value-added services for each of four groups of customers and by geographic area: i) residential price fixed for a minimum 12 month period; ii) residential variable price; iii) small non-residential price fixed for a minimum 12 month period; and iv) small non-residential variable price."

"The averages should be weighted by the amount of commodity sold at each price within each category. ESCOs shall also file the number of customers purchasing products in those categories. ESCOs shall file the required information quarterly, reflecting data over the previous period, within 30 days of the end of each calendar quarter (i.e., data must be provided no later than April 30th, July 30th, October 30th and January 30th of each year), beginning with the data on prices charged in the second quarter of 2014," the PSC said.

The PSC will use this data, "to publish comparative pricing information for the categories identified above."

"We anticipate development of a list of the average price billed for each ESCO, separately for consumers in specific geographic areas of a utility service territory. We expect to sort the list based on average price, and organize ESCOs into quartiles, based on the average price charged to customers in the historical period," the PSC said.

"For the category of variable priced products with no energy-related value-added attributes, we anticipate that comparable information regarding utility charges will also be presented," the PSC said.

"The utility information will be adjusted to account for differences between how ESCOs and utilities charge for bill processing and other charges ... in order [to] facilitate a direct comparison," the PSC said.

The PSC said that Staff will further develop definitions of the product categories and the specific format(s) for reporting the data. "In addition, Staff will explore whether and how this historic pricing information should be posted on the expanded Power to Choose website. These and other implementation issues will be addressed at a technical conference to be held within 60 days of the date of this Order," the PSC said.
