PUC Directs PECO to Publish Price to Compare 45 Days Prior to Delivery, Not 75 Days
In a written order reconsidering PECO's proposal to allow electric Customer Assistance Program (CAP) customers to shop for a competitive supplier, the PUC has directed that PECO maintain the current schedule of publishing the Price to Compare 45 days prior to the effective date.
In its original CAP order, the PUC, in response to PECO's proposal, had ordered that the publication of the Price to Compare be moved forward to 75 days prior to the effective date.
However, in a request for reconsideration, PECO said that the acceleration in the PTC publication was premised on its proposal to require that suppliers serving CAP customers meet or beat the PTC (thus it needed to be published earlier so suppliers could evaluate their ability to beat it)
With the PUC declining to impose any such rate limit on electric suppliers in the CAP program, PECO said in its reconsideration request that the Commission should eliminate the requirement that PECO publish its GSA filing (the basis for the PTC) 75 days in advance. PECO had said in its filing that the longer lead-time inherently causes the GSA projection to lose accuracy, because certain supply cost data (e.g., spot-market prices) must be projected an additional 30 days in advance. In the absence of the proposed price limitation, there is no need for the EGSs to have that additional preparation time, and moving the GSA filing to 75 days prior to effectiveness simply has the disadvantage of a loss of GSA accuracy with no countervailing benefit to customers or EGSs, PECO had said in its filing.
The PUC agreed, noting that, "It has been our position that, to the extent possible, the electric distribution company’s PTC rates should reflect current market conditions."
"Since we are reaffirming our rejection of PECO’s proposed price ceiling for CAP customers, the added lead time for filing PTC revisions is no longer necessary, and therefore, we will grant PECO’s request," under which the PTC will be published 45 days in advance.
On reconsideration, the PUC maintained an April 15, 2014 start date for CAP customer shopping eligibility, but granted PECO until June 15, 2014 to allow CAP customers to participate in the Standard Offer customer referral program, due to the time needed for programming changes.
