Retail Supplier Seeks Waiver to Allow Email Delivery of Enrollment Materials
Infinite Energy, Inc. petitioned for a limited rule waiver at the Georgia PSC in order to provide enrollment materials via email for customers who voluntarily request electronic service.
"Many consumers prefer the speed, convenience, and reduction of paper waste that comes with e-service. The proliferation of online commerce, electronic payment options, and electronic delivery of routine correspondence since the turn of the last century are testament to this preference. Infinite Energy seeks to provide its customers with these benefits, including a green delivery option, expedited delivery of contract documents, faster response times to customer inquiries, and a reduction of potential delays that come with returned mail," Infinite Energy said.
Infinite Energy requested a partial waiver of Commission Rule 515-7-l 0-.02(3), which reads, in relevant part: "Within seven (7) business days following confirmation by the electing distribution company that a customer's service has been switched, the succeeding marketer shall send each new customer via first class enrollment materials that contain, at a minimum, the following information ..."
"Specifically, in the case of customers who voluntarily select electronic delivery of the enrollment materials, the Company asks it be allowed to [provide enrollment materials via email]. Consumers' consent would be captured at the time of enrollment and customers would always retain the option to request paper copies be mailed to them," Infinite Energy said.
"Georgia statutes already envision electronic communication between marketers and customers during the contract formation process," Infinite Energy said, citing requirements for marketers to accept customer contract cancellations via e-mail.
