New York Utilities Seek Delay in Deadline for Retail Market Changes

Several New York utilities have asked for a delay in several requirements imposed on the EDCs in the New York PSC's recent retail market order.

The order required the EDCs, "to implement significant changes to their retail access programs, billing systems, purchase of receivable programs, various agreements and electronic data interchange ('EDI') protocols, with implementation deadlines for these changes ranging between 60, 90, 120 and 180 days following the issuance of the February Order."

However, the utilities noted that specific changes were left to be addressed at future technical sessions.

"The Joint Utilities respectfully submit that it is impracticable and inherently inefficient for the Joint Utilities to attempt to meet the deadlines set forth in the February Order when the specific requirements are currently unknown and will remain unknown until the conclusion of the collaboratives and technical conference and the subsequent issuance of an order as necessary."

"The Joint Utilities and other stakeholders must be permitted an opportunity to fully identify and understand the scope and nature of required system enhancements, billing system modifications, EDI changes and modification of the purchase of receivables programs. Allowing all stakeholders the necessary appropriate time to accomplish these important steps will support the Commission in the achievement of its stated goal of a 'competitive market structure which leads to innovation and other consumer and societal benefits," the utilities said.

"Therefore, pursuant to ordering Clause 12 of the February Order, the Joint Utilities hereby request that you extend the deadlines for utility implementation of changes established in the February Order. Specifically, such deadlines should not commence until the conclusion of the collaboratives and technical conference established by the February Order and the Commission's adoption of recommendations resulting from the collaboratives and technical conference. Postponing these deadlines will allow the Joint Utilities (as well as other stakeholders) to participate meaningfully in collaborative discussions and will encourage more open dialogue with other stakeholders on novel," the utilities said.
