Texas Generator, PUCT Staff Agree on Amendments to Voluntary Mitigation Plan

NRG Energy and Staff of the Public Utility Commission of Texas have filed for Commission approval of an amended voluntary mitigation plan that specifies offering practices that NRG can use when offering its generation resources into the ERCOT real-time and day-ahead energy and ancillary service markets during the term of the agreement and that those offering practices will not be considered an abuse of market power

The amendments reflect changing market design parameters, specifically, the ORDC and the related modification of the existing ancillary service offer floors, as well as the inclusion of additional generating units.

Beth Garza, Acting Director of the Independent Market Monitor, said in an affidavit that the amended plan, "provides appropriate protections against a potential abuse of market power in violation of PURA §39.157(a), while affording increased regulatory certainty to NRG regarding its energy offers in the ERCOT markets."
