Retail Supplier Says PURA Wrongly Called Renewal Notice Non-Compliant

Liberty Power Holdings LLC said in a letter to the Connecticut PURA that a PURA description calling Liberty's renewal notice non-compliant is incorrect

PURA had described Liberty's renewal notice as non-complaint in opening a new case reviewing market-wide compliance with the regulations regarding renewals.

"Liberty Power Holdings LLC ('Liberty Power') hereby submits this letter to correct a potential error made by the Public Utilities Regulatory Authority ('PURA') in its May 23, 2014 docket opening notice in this proceeding," Liberty said.

"Specifically, the PURA notice states that Liberty Power's customer notice failed to meet Conn. Gen. Stat. § 16-245o(f) requirements because it did not 'even inform the customer of the expiration of their fixed price contract.' To the contrary, Liberty Power's customer notice, submitted in its April 29, 2014 response to AD-3 in Docket No. 13-07-18 ('Notice'), plainly informs the customer of the imminent expiration of the fixed price contract. The end date for each contract is auto-filled for each customer at the top of the document after the Notice states in bold, all capital letters 'YOUR FIXED-RATE ELECTRICITY SUPPLY CONTRACT ENDS ON [DATE IS FILLED IN].' The Notice also outlines potential options and provides a link to details on the variable price product that would become effective if the customer failed to take action," Liberty said.

"In light of the above, Liberty Power has filed contemporaneously with this letter (and attached hereto as Exhibit A) a Supplemental Response to AD-3 in Docket 13-07-18 outlining in more detail the facts identified above regarding Liberty Power's customer notice. If PURA finds Liberty Power's Notice to indeed be in compliance, Liberty Power respectfully requests that PURA formally acknowledge this error. Allegations of noncompliance carry significant weight, and may harm business reputations if uncorrected," Liberty said
