Texas Staff File Proposal for Adoption for Changes to Retail Delivery Tariff, Timelines for Discretionary Services Provided to REPs

Staff of the Public Utility Commission of Texas have filed a draft proposal for adoption containing revisions to the Pro-Forma Retail Delivery Tariff.

Generally, among other things, the tariff revisions extend the timelines for discretionary services provided to premises with a standard meter (generally meaning an AMS meter).

For example, the revised tariff would require TDUs, for standard meters, to complete performance of a same-day service order for a Disconnect for Non-Pay within two hours of the receipt of the order, provided the TDU receives the order by 3:00 PM CPT on a business day. Previously, same-day DNP completion was only required if the order was received prior to 2:00 PM CPT.

One change from the proposal for publication concerns disconnection after 5:00 PM CPT. Originally, the proposed revisions provided that a TDU shall not discontinue delivery to a retail customer's point of delivery due to non-payment between the hours of 5:00 PM and 7:00 AM CPT, for a standard meter. However, the proposal for adoption does allow for a "coordinated disconnection" between these hours for certain premises.

Specifically, REPs may coordinate the disconnection of a master-metered Premise, a Chronic Condition Residential Customer, Critical Load Industrial Customer, Critical Load Public Safety Customer, or Critical Care Residential Customer Premises, or any other Premises that presents a life-threatening or otherwise hazardous condition, and such coordinated disconnection may occur between the hours of 5:00 PM and 7:00 AM CPT

Also notable is the removal of an original proposal that would require 45-days notice by the TDU prior to changing a customer's delivery rate schedule.

In a draft preamble, Staff says that, "The commission agrees with the Joint TDUs that it would be inappropriate to allow a customer to remain on a Rate Schedule for which the customer no longer qualifies. Consistent with the commission's decision in Project Number 29637, the commission modifies this Section to remove the advance notice requirement."

The proposal for adoption would also not include proposed tariff language that requires all TDU notices, unless confidential, to be sent to the RMS listserv.

Staff in the preamble says that the original proposal may not achieve the desired result, but affirmed that, "[b]ecause the commission agrees that notice and access to information is essential in the market, the commission directs ERCOT to develop requirements for the specific types of market notices and the time requirements associated with those notices."

The solutions may utilize an existing distribution list or new separate distribution lists to address specific market situations for the TDUs to communicate to the market, Staff said.
