Parties Agree to Resettlement in ERCOT, Odessa-Ector Power Partners Dispute

A settlement resolving a complaint by Odessa-Ector Power Partners L.P. against ERCOT concerning ERCOT's manual overrides of Odessa-Ector Power Partners, L.P.'s High Dispatch Limit (HDL) on November 15, 16, and 20, 2012 calls for resettlement of the disputed intervals.

The settlement agreement provides that ERCOT will grant Odessa's settlement dispute (Settlement Dispute Nos. 1-1150737761, 1-1152712811, and 1-1150737791) relating to Operating Days November 15, 16, and 20, 2012.

Further, ERCOT will resettle the disputed intervals for these Operating Days by utilizing the settlement methodology in Protocol Section 6.6.7.1(4), Voltage Support Service Energy Amount, and provide compensation through Odessa's QSE. Odessa had originally been seeking a total payment of $320,000 with respect to the three operating days at issue

The agreement further provides that no later than 60 days after it is executed, ERCOT agrees to sponsor a Nodal Protocol Revision Request (NPRR) to address the settlement of future high dispatch limit ("HDL") / low dispatch limit ("LDL") overrides by ERCOT, specifically providing for lost opportunity compensation when an HDL/LDL override restrains a Resource's output.

The settlement was signed by ERCOT, Odessa-Ector Power Partners, and Staff of the Public Utility Commission of Texas. According to the settlement filing, Merrill Lynch Commodities, Inc., Odessa's Qualified Scheduling Entity on the subject Operating Days, also is a signatory for limited purposes.
