Starion, OPC File Status Report on D.C. Settlement

Starion Energy and the District of Columbia Office of the People's Counsel have filed a status report with the D.C. PSC regarding an earlier settlement addressing Starion complaints and marketing practices.

The PSC had requested the status report due to the receipt of complaints against Starion after its approval of the settlement agreement. Starion had previously told Matters that the new complaints related to customers enrolled prior to the settlement.

In their response to the PSC, Starion and OPC reported that OPC has received 34 complaints against Starion since February 6, 2014, and confirmed that customers who lodged these complaints were enrolled as Starion customers prior to the approval of the settlement agreement. Additionally, some of these complaints were received from consumers whose complaints were considered under the terms of the settlement agreement.

"The Parties have continued to communicate to ensure that all complaints are handled appropriately and in accordance with the terms of the Settlement Agreement. It should be noted that the Parties anticipated additional complaints against Starion once area media outlets and social media began reporting the Parties entering into the Settlement Agreement," Starion and OPC said.

Starion and OPC also reported that the tallying of consumer complaints for the purpose of identifying any continuing marketing or solicitation issues with Starion as contemplated under the settlement agreement will commence once marketing materials are approved and Starion re-commences solicitation of new customers in the District.

Starion confirmed in the status report that it is not marketing to new customers in the District.

Starion is continuing to execute customer refunds as contemplated under the settlement, and anticipates having a final batch prepared for OPC's review on or about July 25, 2014. "It is the Parties' goal to mail all refund checks on or before August 8, 2014," Starion and OPC said.

Following the mailing of all refund checks, the Starion and OPC said that they will then turn their attention to how Starion will market its products and services in the District going forward. Starion's marketing documents will be forwarded to OPC within 60 days of the mailing of the last batch of refund checks.

"OPC and Starion will then begin exchanging ideas and suggestions for the purpose of fashioning an appropriate marketing process, including creating suitable marketing materials so that Starion may re-commence marketing and soliciting customers in the District ... There is no target date for completion of this phase, as the focus of these discussions will be on getting the marketing process and materials in a form that is both in compliance with the District's laws and agreeable to the Parties. The Parties, however, are committed to completing the document review as expeditiously as possible. To date, the Parties have cooperated well and each has worked diligently to move the terms of the Settlement Agreement forward. The Parties are confident that the marketing phase of the Settlement Agreement will be approached with the same attention to detail and cooperation. The Parties recognize that marketing products are of critical importance and will devote the necessary time and resources to this endeavor. This level of attention will ensure that when Starion begins to solicit new customers in the District, it will do so in a manner that is consistent with DC policy," Starion and OPC said.

Starion and OPC confirmed that within 5 days of their agreement on the marketing documents, they will file the agreed upon documents with the PSC pursuant to the terms of the settlement agreement.

Starion and OPC also confirmed that Starion's one-year probationary period under the settlement has not started, and that it has always been the intention of the parties to commence the probationary period following the filing of Starion's renewed marketing materials with the Commission.
