Retail Supplier Responds to PURA Opening Docket Reviewing Guaranteed Savings Product
Choice Energy, LLC submitted the following letter to the Connecticut PURA concerning a review of Choice Energy's marketing and billing practices in Connecticut, and specifically the terms of its guaranteed savings product.
PURA has not issued any formal declarations concerning the docket yet, but in a notice opening the docket, said, "Choice marketing materials guarantee savings in comparison with local EDC rates, but Choice maintains that those savings are only certain if the customer remains with Choice for a period of no less than one year."
PURA also took administrative notice of several customer complaints as well as Choice's terms of service, which Choice specifically addressed in its letter to PURA.
The text of PURA's letter is below:
Choice Energy, LLC d/b/a 4 Choice Energy, LLC ("Choice") is in receipt of the Public Utilities Regulatory Authority' s ("Authority" or "PURA") July 24, 2014 Notice taking administrative notice of certain documents. Choice does not object to the Authority's taking of administrative notice of the enumerated documents, but Choice disagrees with the allegations contained in the documents and reserves all rights to contest the accuracy or truthfulness of such documents at a later date or to introduce additional pertinent documents.
The record also should reflect that Choice discontinued the savings guarantee discussed in the noticed documents in Connecticut more than a year-and-a-half ago. Choice has no intention of resuming the guarantee program, but reserves all rights to defend the merits of such program or any current practices in the event the Authority does not dismiss this docket.
