Draft Decision Would Effectively Preclude Sale of Electric Supplier Customer Books
A draft Connecticut PURA decision would effectively preclude the sale of electric supplier customer books via contract assignment, by requiring affirmative consent of the customer for any such assignment.
The draft provides that an electric supplier seeking to assign the customer contracts to another supplier must notify PURA of the proposed assignment at least 15 days prior to the assignment and submit for the Authority’s approval
"The customer must be provided at least 30 days to consider the assignment and express consent is required (i.e., consent by default is not allowed)," the draft provides.
The draft only discusses assignment. To the extent a supplier purchases the entity holding an electric supplier license and serving customers, it is unclear whether such customers could be acquired without affirmative customer consent (but such a transaction would undoubtedly require PURA approval for a transfer of the license).
