FERC Staff Seek to Subpoena Information From Marketers for Investigation
FERC Enforcement Staff has petitioned an ALJ to issue subpoenas duces tecum to several natural gas marketers, who are not parties to an instant investigation, as Enforcement is seeking to compel such marketers to produce documents relating to marketers' transactions with BP Energy and affiliates, and other sales at relevant trading points, as various BP Energy companies are subject to a contested FERC enforcement proceeding which has alleged manipulation of the next-day, fixed-price gas market at Houston Ship Channel from mid-September 2008 through November 30, 2008 (click here for background)
Enforcement Staff asked that subpoenas be issued to Integrys Energy Services, Inc., Tenaska Marketing Ventures, Castleton Commodities International LLC, and El Paso Marketing Company, L.L.C. The companies are not parties to the investigation.
Under the subpoenas sought by Staff, the marketers would have to produce the requested documents within 10 business days.
Subpoenas have already been issued to pipeline owners, integrated companies, and trading and price reporting platforms, but these are the first we've seen issued to pure-play marketers.
