GDF Suez Files Complaint at FERC Over Inaccurate ConEd Meter Data, Seeks Refund

GDF Suez Energy Resources, NA filed a complaint at FERC concerning ConEd's submission of estimated data to NYISO for billing purposes which grossly overstated the consumption of a Suez customer, and which was not corrected until after the close of the NYISO settlement deadline

GDF Suez asked FERC to:

(a) reopen and resettle billings for electricity supplied by the NYISO during the November/December 2012 billing period; and

(b) refund over-charges paid by Suez for electric service from the NYISO during the November/December 2012 billing period based on erroneous consumption data submitted by Consolidated Edison Company of New York, Inc., with interest. This consumption data was later corrected after the NYISO settlement correction window had closed,

Suez said that ConEd provided estimated consumption to NYISO in December 2012 and January 2013 that overstated a Suez customer's (New Water Street) electricity consumption during the relevant billing periods by approximately 9.7 GWh (i.e., by more than 260%)

Months later, on June 27, 2013, and again on August 24, 2013, Con Ed issued corrected consumption data for New Water Street during the November/December 2012 billing periods that had been relied on by NYISO and Suez. However, because the corrected settlement information was not supplied by Con Ed until after the NYISO settlement deadline for those billing periods had passed, the NYISO believes it cannot issue corrected invoices for the November/December 2012 settlement periods without the FERC order requested herein.

Suez told FERC that it now understands that Con Ed initially provided estimated consumption data because actual metered data was unavailable due to flooding in lower Manhattan that occurred in October 2012 as a result of Hurricane Sandy, a fact which Suez said it was informed of by ConEd after the NYISO settlement deadline had passed.
