Regulator Grants Waiver to Retail Supplier to Allow Email Delivery of Enrollment Materials
The Georgia PSC recently issued a written order granting Infinite Energy, Inc. a limited rule waiver to allow Infinite to provide enrollment materials via email for customers who voluntarily request electronic service.
Infinite Energy was granted a partial waiver of Commission Rule 515-7-l 0-.02(3), which reads, in relevant part: "Within seven (7) business days following confirmation by the electing distribution company that a customer's service has been switched, the succeeding marketer shall send each new customer via first class enrollment materials that contain, at a minimum, the following Specifically, in the case of customers who voluntarily select electronic delivery of the enrollment materials, Infinite Energy asked that it be allowed to provide enrollment materials via email. Consumers' consent will be captured at the time of enrollment and customers will always retain the option to request paper copies be mailed to them, Infinite Energy said.
In its petition, Infinite Energy noted that Georgia statutes already envision electronic communication between marketers and customers during the contract formation process, citing requirements for marketers to accept customer contract cancellations via e-mail.
The PSC approved Infinite Energy's requested waiver as filed.
