State Issues Notice of Violation to Eight Retail Suppliers Over Gross Receipts Reporting, RPS Compliance

The Connecticut Public Utilities Regulatory Authority has issued notices of civil penalties against eight retail suppliers concerning alleged failure to pay RPS alternative compliance payments, alleged failure to submit required receipts for such payments, or alleged failure to file annual reports on their intrastate gross revenues.

PURA issued a notice of violation to Reliable Power, LLC seeking to impose a penalty of $4,689, alleging that according to August 8, 2014 correspondence from the distribution utilities, Reliable Power has not paid $2,600 in RPS alternative compliance payments for the year 2011. PURA also alleged that Reliable Power has not submitted receipts for the payments to PURA.

PURA issued a notice of violation to HOP Energy, LLC seeking to impose a penalty of $2,766.80, alleging that according to August 8, 2014 correspondence from the distribution utilities, HOP Energy has not paid $1,200 in RPS alternative compliance payments for the year 2011. PURA also alleged that HOP Energy has not submitted receipts for the payments to PURA.

PURA also issued notices of violations separately to Constellation NewEnergy, Inc. and Direct Energy Business, LLC, seeking to impose a penalty of $1,000 on each company. PURA alleged that although both companies paid their 2011 ACPs, the companies each allegedly did not file receipts confirming such payments with PURA, as PURA said was required by its RPS decision.

PURA also issued notices of violations to the four suppliers below, alleging each has failed to file the required intrastate gross revenues report for the year 2013. PURA is seeking to impose a $5,000 penalty for each supplier listed below.

Glacial Energy of New England, Inc. 
South Jersey Energy 
Spark Energy, LLC 
XOOM Energy Connecticut, LLC 

Note: These are NOVs as posted by PURA as of September 8. Additional NOVs may be issued today.

Additionally, though PURA said it had "reason to believe" the alleged violations occurred, we are aware of prior instances in which PURA informed a supplier it had failed to file a required report and PURA alleged a violation, but the supplier had filed the report and PURA's belief was mistaken
