Regulator Directs Suppliers to Begin Reporting Historic Variable Rates, Provides Instructions

The Connecticut PURA yesterday directed retail electric suppliers to begin reporting historic variable rates.

Under recently adopted legislation, suppliers shall make available to the Authority for posting on the Authority's website, and shall list on the supplier's own website, on a monthly basis, the highest and lowest electric generation service rate charged by the licensee as part of a variable rate offer in each of the preceding twelve months to any customer with a peak demand of less than fifty kilowatts, cumulated of all such customer's meters, during a twelve-month period…

PURA directed suppliers to submit their first filing in compliance with this statutory mandate by October 5, 2014.

"Subsequent monthly filings must be submitted on or before the 5th of each month," PURA said.

"The [October 5] filing shall include the highest and lowest variable rates charged to any customer in the twelve month period beginning October 2013 (i.e., October 2013 through September 2014, inclusive)," PURA said.

"As used in this section, 'cumulated of all such customer's meters' shall mean the total peak demand of multiple meters for a single customer," PURA said.

"If you did not charge a variable rate to any customer in any of the preceding twelve months you must attest to that fact in the filing on October 5, 2014, and no further compliance filings are required unless you begin charging variable rates at which time you must submit monthly filings," PURA said.

PURA also provided a template for the format of the historic rate submissions.

Regarding the obligation of suppliers to post the historic rate information on their website, PURA noted that, "The statute expressly requires each supplier to provide historical rates on the 'licensee's own Internet web site,' ... therefore, a webpage on another's company's website will not comply with this statutory mandate."

"The historical variable rates must be provided on a separate web page on your website, using the shortlink 'past_variable_rates' in the URL (e.g., supplier.com/past_variable_rates. Historical Variable Rates must be provided in $/kWh and displayed in the graph and table format shown [in PURA's directive], with no deviation from the graphic display or text. No other information may be provided on this web page. In addition, a navigational link labeled 'Past Variable Rates' must be clearly visible from all pages on your website," PURA said.

On or before October 30, 2014, PURA directed suppliers to submit: (1) the link to their website; (2) a screenshot of the home page of their website; and (3) a screenshot of the past variable rates webpage on their website. If a supplier did not charge a variable rate to any customer in any of the preceding twelve months, it is required to provide only (1) the link to its website and (2) a screenshot of the home page of its website.

PURA's direction came in individual letters to suppliers. The PURA graph templates required to be used can be seen here, in one of the letters to a specific supplier.
