Texas REPs Challenge POLR Designations

Several Texas retail electric providers challenged their designation as non-volunteer POLRs based on not serving certain customer classes in certain TDU areas.

The requests made thus far relate to the Sharyland Utilities LP service area, which newly opened to choice, and whose initial POLR list was developed using ERCOT-wide market share data, given the recent introduction of choice to the region.

StarTex Power requested to be removed as a residential Large Service Provider in the Sharyland Utilities LP service area, as it does not serve residential customers in that territory.

ConEdison Solutions asked to be removed as a Large Service Provider for all applicable classes at Sharyland Utilities LP since it does not serve customers at Sharyland Utilities

CPL Retail Energy, LP, Direct Energy, LP, First Choice Power Special Purpose, LP, and Direct Energy Business, LLC also stated that they do not currently serve customers in the new Sharyland Utilities, LP service area for any of the four POLR customer class types, and accordingly requested that they not be designated as REPs eligible to be POLR in the Sharyland Utilities, LP service area.

Several REPs also clarified affiliate responsibilities regarding POLR service.

StarTex publicly confirmed that its affiliate Constellation NewEnergy, Inc. has requested that StarTex Power be designated as the affiliate to provide POLR service on CNE's behalf should CNE be designated as POLR for the residential or small non-residential customer classes in all the TDU service territories for the 2015-2016 term.

WTU Retail Energy clarified that Direct Energy Business, LLC should be assigned WTU's LSP responsibility for the medium non-residential customer class in the AEP North service area; CPL Retail Energy had been erroneously listed as the designated affiliate on a preliminary chart.
