Connecticut Waives More Sought Penalties Against Retail Suppliers Regarding Gross Receipts Report

The Connecticut PURA has waived $5,000 penalties originally sought against South Jersey Energy Company and North American Power and Gas, LLC after PURA initially alleged that each company failed to submit a report on intrastate gross receipts.

PURA said that each company acknowledged to the Authority that the Company’s Connecticut Intrastate Gross Revenues Report for the year 2013 was not timely filed with PURA.

"By letter dated September 15, 2014, South Jersey Energy Company (SJE) acknowledged to the Authority that the Company’s Connecticut Intrastate Gross Revenues Report for the year 2013 (Report) was not timely filed. However, SJE provided evidence showing that it submitted its Report to the Department of Energy and Environmental Protection on August 22, 2014. SJE also stated that it has put into place a new procedure to ensure that this administrative oversight will not happen in the future," PURA said.

"By letter dated September 17, 2014, North American Power and Gas, LLC (NAPG) acknowledged to the Authority that its Connecticut Intrastate Gross Revenues Report for the year 2013 (Report) was not timely filed. However, NAPG provided evidence showing that it submitted its Report to the Department of Energy and Environmental Protection on August 21, 2014," PURA said.

However, PURA said that the gravity of the violation and eventual compliance warrants consideration in terms of waiving any penalty for not filing the report by the due date

Given the scope of the apparent violation, the Authority will waive the proposed civil penalty for each supplier's failure to timely submit its Connecticut intrastate gross revenues for the year 2013. The Authority cautioned each supplier to ensure timely compliance with all of its Connecticut regulatory obligations going forward.
