Final PURA Decision Drops Declaration That Authority Will Investigate Two Suppliers

A final Connecticut PURA decision concerning retail supplier customer notice requirements (click here for related story today) does not state any intent by PURA to investigate two suppliers' compliance with the rules governing the use of third-party agents.

In an earlier draft (click here), PURA stated that it intended to initiate an investigation into Choice Energy LLC and Discount Power, Inc. concerning each's compliance with the agent training requirements, based on various statements each supplier had made raising concerns with proposed new requirements.

PURA had interpreted such statements as meaning that the two suppliers did not know the identities of the agents who have been selling electric generation services on their behalf and therefore could not have trained the agents as required.

Both suppliers vigorously objected to PURA's interpretation as flawed and erroneous, objecting that PURA was inappropriately relying on non-evidentiary policy statements made in exceptions to an earlier PURA draft decision to extrapolate the business practices of a supplier.

Both suppliers pointed to their responses to prior interrogatories as showing they were compliant with the training requirements

PURA's final decision omits the draft's conclusion that the suppliers did not know the identities of their third-party agents and therefore could not train them. The final decision omits any statement of an intent to investigate the suppliers.
