PSC Issues Show Cause Order to 10 Retail Suppliers

The District of Columbia PSC issued show cause orders to 10 retail electric suppliers after the PSC alleged that the suppliers failed to respond to a prior directive to confirm the data used in their filed fuel mix reports, while directing numerous other suppliers to file reports or bring their filings into compliance

The PSC directed Clearview Energy, Devonshire Energy LLC, Direct Energy Business, LLC, Horizon Power and Light, NextEra Energy Services District of Columbia, LLC, Public Power, LLC, Reliant Energy Northeast LLC – now doing business as NRG Residential Solutions, Starion Energy PA, Inc., UGI Energy Services, Inc., and Viridian Energy PA, LLC to show cause within fourteen days why the Commission should not take action against them that may result in the suspension or revocation of their respective licenses or the imposition of a civil penalty for allegedly failing to respond to a September 2013 Commission directive to confirm that the PJM residual mix had been used to produce their Fuel Mix Reports, or respond to other directives regarding the reports.

The PSC also said that, "Ambit Energy, American Power Partners, Clearview Energy, Devonshire Energy, Horizon Power and Light, and Starion Energy failed to file their December 2013 Fuel Mix Reports pursuant to 15 DCMR § 4201.2."

Additionally, the PSC said that, "Ambit Energy, American Power Partners, Clearview Energy, Consolidated Energy Solutions, Devonshire Energy, Horizon Power and Light, IDT Energy, and Integrys Energy Services, failed to file their June 2014 Fuel Mix Reports pursuant to 15 DCMR § 4201.2."

Regarding companies that have filed reports, the PSC directed further filings from such suppliers to bring the suppliers into compliance, stating, "AEP Energy, DC Gas and Electric, Direct Energy Business, Glacial Energy, Hess, Liberty Power, NextEra Energy Services, PPL EnergyPlus, Public Power, NRG Residential Solutions, and Viridian Energy, appear to be reporting the PJM system mix rather than the PJM residual mix as required by 15 DCMR §§ 4201.2 and 4201.6. Additionally, Liberty Power reported information for less than one calendar year as required by 15 DCMR § 4201.2. Finally, four (4) retail electric suppliers: Constellation NewEnergy, GDF Suez Energy Resources NA, Stream Energy, and UGI Energy Services, correctly provided the PJM residual mix, but did not make it clear whether their RECs were accounted for in their reporting pursuant to 15 DCMR § 4201.5."

"The Commission does not take lightly the compliance filing requirements and looks with disfavor on the failure of retail electric suppliers to respond to the Commission when required by applicable regulations and Commission directives by order," the PSC said.
