MP2 Energy LLC has suggested in comments to the Public Utility Commission of Texas that the Commission, "should consider whether an update to the EFL [Electricity Facts Label] content requirements would be beneficial."

MP2 Energy's comments came in a project concerning updates to the Power to Choose website. MP2 Energy offered some discrete suggestions for Power to Choose (such as differentiating on the site renewable supply versus excess renewable generation buy-back programs, and green plans based on RECs versus power sourced directly from renewable generation), but said that, "MP2 believes that the source of much of the consumer's confusion is not rooted in the PTC website, rather originates in the information required on the residential EFLs pursuant to PUC Subst. R. 25.475(g) from which PTC sources information."

"As a result, in order to ensure that the more clear information discussed above is reflected in the PTC, it may be necessary for the Commission to update its requirements for the EFLs. MP2 recognizes these issues fall outside of the scope of Project No. 43787. However, due to the closely related nature of EFLs and PTC, it is suggested that this be taken into consideration," MP2 said.
