N.Y. Utilities: Muni Aggregation Plans Should Require PSC Approval

Should the New York PSC determine that municipalities should be permitted to conduct opt-out aggregations, the New York utilities said that the PSC should review and approve "detailed" aggregation plans prior to implementation.

In comments to the PSC, the joint utilities suggested that:

"If the Commission does determine that CCA programs should be permitted in New York, the Joint Utilities recommend that, prior to implementation of a CCA program, the municipality should be required to submit a detailed plan to the Commission for review and approval to ensure that the plan complies with the requirements established by the Commission for CCAs, including the provision of adequate consumer protections, and applies to customers in an appropriate and clearly defined geographic area. Additionally, the plan should include a draft copy of the proposed form of its supply agreement. The municipality also should be required to provide copies to the affected utility or utilities and the process should provide for review by interested stakeholders and the State of New York Department of Public Service (Staff) prior to implementation. The Joint Utilities also recommend that, each time an aggregation is proposed, an aggregation plan be developed by the municipality and submitted to the Commission for review and approval."
