Texas Staff Recommend Expedited Review of REP Certificate Application To Avert Potential POLR Drop

Staff of the Public Utility Commission of Texas have recommended that the Commission expedite its review of Agera Energy's application for a retail electric provider certificate given a February petition from Glacial Energy to convert its bankruptcy proceeding from Chapter 11 to Chapter 7

As previously reported, Agera Energy has been designated the purchaser of Glacial's retail energy businesses.

Although Glacial has reached a settlement with certain parties to withdraw its request to convert its case to Chapter 7, "Staff believes it is still in the best interest of Glacial's current customers to expedite the approval process for Agera's application."

Staff said that a conversion of the bankruptcy from Chapter 11 to Chapter 7 could result in Glacial's current customers in Texas becoming customers of a provider of last resort.

Staff has found Agera Energy's application for a REP certificate to be complete, and recommended that a deadline of March 30 be set for a Staff recommendation on final disposition of the application. Staff recommended that an order approving or denying the application be issued by April 6.
