Retail Energy "Self-Regulation" Coming to New York?

The New York PSC issued a discussion document drafted by Staff in advance of a previously reported technical conference on ESCO eligibility requirements (licensing), and one of the considerations is the introduction of "self-regulation" into the retail energy market.

Staff posits that, "[a]reas of oversight where limited self-regulation of ESCOs may be appropriate, under current market conditions or potentially in the future, could be identified and discussed."

Staff stressed that, "This would not be in place of state oversight and requirements."

Staff asks:

a. In what areas of oversight would self-regulation be appropriate?

b. What conditions need to exist for self-regulation?

Some type of self-regulation (or similar self-policing) has been proffered by organizations such as the National Energy Marketers Association, whose national Restructuring Conference we are attending today.
