New York Adopts Joint Proposals With Retail Access Provisions

The New York PSC yesterday adopted joint proposals concerning rate cases at Consolidated Edison and Central Hudson Gas & Electric which include provisions relating to retail access.

At ConEd (Case 15-E-0050), the joint proposal adopted by the Commission requires the establishment of a collaborative to address advanced meter deployment at ConEd, with the PSC directed to rule on ConEd's AMI plan by January 2016. ConEd had originally proposed its AMI plan in the rate case, which calls for deployment to begin in 2016, to be completed by 2023.

Among other things, the PSC stressed that the collaborative should consider whether third-party ownership of smart meters is appropriate.

In developing the AMI plan, ConEd shall consider the feasibility of providing access to near real-time data to customers and third parties that are authorized to have access to customer data, including authorized third party energy services providers (e.g., an energy services company).

The ConEd joint proposal is also notable for not addressing any expansion of the hourly priced default service cutoff. ConEd, in the rate case, had originally proposed to lower the cutoff for mandatory hourly pricing (MHP) for default service customers from 500 kW to 300 kW over a four-year period, from 2016 to January 2019.

At Central Hudson (Case 14-G-0319), the adopted joint proposal provides that a revised cash-out process for the natural gas retail access program will be implemented, no earlier than April 2016, to cash-out, in any given month, those accounts with valid meter readings during the month.

"Cost recovery will be provided for all incremental external costs Central Hudson incurs to implement this 'semi-monthly' cash-out process," the JP provides

The Central Hudson JP also provides that the commodity component of the Winter Bundled Service (WBS) price will be revised each month to reflect Central Hudson's actual weighted average cost of storage (WACOS) for the preceding month. The methods utilized to determine the non-commodity components of the WBS price will remain unchanged.

The resulting WBS price will be made available on the company’s website. Due to timing differences between the availability of pricing data and filing requirements, the WBS price and the WACOS will be included on Central Hudson's Statement of Firm Transportation Rates on a one month lag.

The Central Hudson JP also provides that upon expression of written interest from three or more members of the retail access community, Central Hudson will initiate a collaborative for the purpose of discussing and addressing any specific operations or other concerns.
